1. Overview

This Privacy Policy describes how Nocturne AI LLC ("Nocturne AI," "we," "our") collects, uses, and protects personal information across our products and services.

This is our master privacy policy, covering the LLC's general practices and our products that do not have their own dedicated policy. Some products — including CheerBanq — maintain separate, product-specific privacy policies that take precedence for those products. Where a product has its own policy, this document covers only the residual LLC-level practices (corporate contact, legal basis, your overall rights as a Nocturne AI customer).

2. Information We Collect

2.1 Information you provide directly

• Account or contact details — Your name and email address if you sign up for product updates, contact support, or submit an inquiry through our website.
• Communications — The content of any emails or messages you send us.

2.2 Nexus Memory (browser extension)

The Nexus Memory extension is designed to keep your data on your device. We collect minimal information server-side:

• Anonymous user ID — A randomly generated identifier (e.g., nexus_1234567890_abc) used only for subscription management. Not tied to your identity unless you provide an email.
• Email address — Optional. Only if you provide it in extension Settings for product updates and account recovery.
• Platform detection — Which AI platforms you use the extension with (Claude, ChatGPT, Gemini, Perplexity). Used to maintain compatibility.
• Usage analytics — Off by default. If you opt in, we collect anonymized token-efficiency metrics. We do not collect conversation content even when analytics are enabled.

2.3 Website visitors (nocturneai.net)

• Technical information — IP address, browser type, device type, operating system, referring page, and pages visited.
• Analytics — Aggregated traffic data through Google Analytics. This data does not personally identify you.
• Search Console data — Aggregated search query data provided by Google for SEO purposes.

2.4 Information from service providers

• Payment processors — If you make a purchase or subscribe to a product, our payment processor handles your payment information directly. We receive only confirmation of successful payment and your subscription status, not your full payment details.

3. How We Use Your Information

We use the information we collect to:

• Provide, maintain, and improve our products.
• Authenticate accounts and manage subscriptions where applicable.
• Respond to support requests and inquiries.
• Send service updates and important notices.
• Send product news and updates (only if you opt in).
• Detect, prevent, and respond to fraud, abuse, or security issues.
• Comply with legal obligations.

We do not:

• Sell your data to third parties.
• Share your data with advertisers.
• Use your conversation content to train AI models.
• Profile you for marketing purposes.

4. How We Share Information

We do not sell your personal data. We share information only in these limited cases:

4.1 Service providers

We use a small number of trusted service providers to operate our products. They process data only on our behalf and under contractual obligations:

• Hosting and infrastructure — Standard cloud hosting providers for our website and product backends.
• Email — Our email service provider, used only if you have provided an email address to us.
• Payment processing — If you make a purchase, our payment processor handles the transaction.
• Analytics — Google Analytics for aggregated website analytics.

4.2 Legal requirements

We may disclose information when required by valid legal process (subpoena, court order, or applicable law), or to protect our legal rights, prevent fraud, or protect the safety of our users or the public.

4.3 Business transfers

If Nocturne AI LLC is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.

5. Data Retention

• Account and contact data — Retained while your account or relationship with us is active, plus 30 days after closure or last contact.
• Anonymous Nexus Memory user IDs — Retained while the extension remains installed and active. Deleted upon extension uninstall plus 30 days, or upon explicit request.
• Analytics data — Aggregated, anonymized analytics data may be retained for up to 24 months.
• Legal compliance records — Retained as required by applicable law.

You may request earlier deletion of your data at any time (see Section 7).

6. Security

We use reasonable technical and organizational measures to protect your information:

• Encryption in transit for data sent between your device and our servers.
• Access controls limiting employee and contractor access to data on a need-to-know basis.
• Standard cloud security practices through our infrastructure providers.
• Local-only storage for sensitive data where feasible (e.g., Nexus Memory conversation content).

No system is completely secure. We cannot guarantee absolute security but work to follow current industry practices.

7. Your Rights and Choices

You have the following rights with respect to your personal data:

• Access — Request a copy of the personal data we hold about you.
• Correction — Request that we correct inaccurate or incomplete information.
• Deletion — Request that we delete your personal data, subject to legal retention requirements.
• Portability — Receive your data in a machine-readable format where applicable.
• Withdraw consent — Where we rely on your consent, you may withdraw it at any time.
• Opt out of marketing — Unsubscribe from any marketing emails using the link in the email, or by contacting us.

To exercise any of these rights, email data-requests@nocturneai.net. We respond to all requests within 30 days, or sooner where required by law.

Regional rights

• EU / EEA and UK residents — You have rights under the General Data Protection Regulation (GDPR), including the right to lodge a complaint with your local supervisory authority.
• California residents — You have rights under the California Consumer Privacy Act (CCPA), including the right to know, delete, correct, and opt out of sale (we do not sell your data).
• Other jurisdictions — We comply with applicable privacy laws in jurisdictions where we operate.

8. Children's Privacy

Our products are not intended for children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us at privacy@nocturneai.net and we will delete it.

Product-specific policies (such as CheerBanq's) may include additional provisions for products that involve information about minors.

9. International Data Transfers

Nocturne AI LLC is based in Texas, United States. If you access our products from outside the United States, your data may be processed in the United States or in other countries where our service providers operate. We use appropriate safeguards for international transfers as required by applicable law.

10. Changes to This Policy

We may update this Privacy Policy from time to time. For material changes, we will provide at least 30 days' advance notice through our website and, where we have your email address, by email. Continued use of our products after the effective date constitutes acceptance of the updated policy.

Previous versions of this policy are available on request.

This Privacy Policy is governed by the laws of the State of Texas. Any disputes arising from this policy or our handling of personal data will be resolved in the courts of Comal County, Texas.

If any provision of this policy is found unenforceable, the remainder of the policy remains in full effect.
